YACHTLIFE TECHNOLOGIES, INC
Your use of YachtLife's products, software, services, website, and any mobile applications (collectively "Services") is subject to the terms of this User Agreement (this "Agreement"). YachtLife refers to YachtLife Technologies, Inc., and for the purposes of this agreement will be referred to as "YachtLife", "us", "we", or "our". If you are accessing the Services on behalf of an organization or other legal entity, "you" or “Client” refers to that entity, and you warrant that you have the authority to bind that entity. By using the Services, you are accepting the terms and conditions set out in this Agreement and our Privacy Policy, which is incorporated herein. Failure to comply with the Terms may result in denial of access to YachtLife’s Services and cancellation of your YachtLife account.
You acknowledge the Terms by either: (i) clicking to accept or agree to the Terms where this option is presented to you in the user interface of any Service by YachtLife; or (ii) by actually using our Services. In relation to (ii), you agree that YachtLife considers your utilization of the Services as acceptance of the Terms from that point forward.
YachtLife retains the right to alter, add, or subtract from these Terms at its discretion. You're encouraged to periodically check the Services and the Terms for modifications. Continued usage of the Services after the Terms have been modified signifies your acceptance of the altered Terms.
Users recognize and agree that before finalizing a booking, you may need to sign a separate contract or waiver, specifically between the You and the Boat Owner. This separate contract might impose additional conditions on your booking or service.

As a precondition of your use of our Services, you declare and guarantee that:
Sharing contact details or any attempt to engage directly with users outside of YachtLife's platform is prohibited. Any violation will result in account suspension.
Account Safety:
It's vital to safeguard your account details. Any user accessing YachtLife with your credentials will be treated as "you", and you will be held accountable for their actions.
Proprietary Materials:
The Services contain proprietary materials such as logos, text, software, photos, video, graphics, music and sound. YachtLife is the owner or licensee of all such proprietary material and all intellectual property rights therein, including without limitation, copyrights and trademarks. In using the Services, you agree not to upload, download, distribute, or reproduce in any way any such proprietary materials without obtaining YachtLife’s prior consent, except you may make limited copies of your booking documents (and related documents) for boat rentals booked through the Services.
The charter/booking fee, along with any supplementary charges, may be subjected to pertinent local, federal, and state taxes. From the "Effective" date specified on the first page above, YachtLife, as it integrates its tax collection and reporting system, will in some regions charge and collect from the Client all applicable taxes YachtLife is obligated to gather. These are imposed by a governmental authority on the charter amount and other associated charges that form the basis upon which such taxes are imposed and are payable by the Client through the Services.
If a Boat Owner cancels a confirmed charter before it begins, the Client will be refunded all amounts paid to YachtLife for the charter, excluding the Transaction Fee and any taxes YachtLife paid out to a tax authority before the cancellation.
If a Client cancels a confirmed charter before it begins, YachtLife will issue the Client a “Cancellation Refund,” as detailed below. The Transaction Fee and any relevant taxes collected by YachtLife and passed on to the appropriate tax authority before the cancellation won't be returned to the Client. The Cancellation Refund's magnitude is determined by the Boat Owner’s cancellation policy stipulated in the Client’s independent charter agreement (if applicable):
If the Client’s individual charter agreement with the Boat Owner either doesn't contain a cancellation policy or contains a policy that deviates from the above options, the Cancellation Refund will adhere to the “Strict” policy mentioned. Clients are also bound by any extra cancellation conditions mentioned in each listing's terms. If there's any inconsistency between a particular listing's cancellation terms and the terms provided herein, this document's terms will take precedence.
If YachtLife provides a Cancellation Refund to the Client that's less than the full charter price, Boat Owners will be credited with the amount not refunded on the Owner’s subsequent charters booked on the YachtLife platform.
Transaction Fees are non-refundable. YachtLife will impose a fee for any charter canceled after both parties have approved a booking.
The user will incur the cancellation fees on their subsequent charter completed via YachtLife. Clients are bound by the cancellation terms mentioned in each listing's terms. Moreover, if a Boat Owner cancels a charter for reasons not related to weather or other safety concerns of the Client, the Boat Owner, not the Client, will be charged the Transaction Fee for the charter as described above.
